These Terms and Conditions set out the basis on which Waste Clearance Kingston provides waste collection and clearance services to domestic and commercial customers. By making a booking, using our services, or allowing our operatives access to your premises, you agree to be bound by these Terms and Conditions.
In these Terms and Conditions, the following expressions have the meanings set out below:
Customer means any individual, business, organisation, landlord, agent or other party that requests or receives services from Waste Clearance Kingston.
Services means any waste removal, rubbish clearance, bulky waste collection, recycling, loading, transport or related activities provided by Waste Clearance Kingston.
Waste means any items, materials, goods, refuse or belongings that the Customer asks us to remove, whether domestic or commercial in nature, excluding any items that are prohibited by law or under these Terms and Conditions.
Agreement means the contract between the Customer and Waste Clearance Kingston comprising these Terms and Conditions and any confirmed booking or quotation.
Waste Clearance Kingston provides waste and rubbish clearance services, including but not limited to household waste removal, office clearance, garden waste removal, bulky item collection, and general waste management. Services are subject to availability and may vary depending on location and access.
We reserve the right to refuse to collect any waste that we reasonably believe is hazardous, prohibited, incorrectly described, contaminated, or not as agreed at the time of booking. We also reserve the right to adjust the quotation if the volume, type, or location of waste differs from the information provided by the Customer when booking.
3.1 Making a booking
Bookings may be made by telephone, email, or through any booking system we operate from time to time. When making a booking, the Customer will be asked to provide details of the waste to be removed, the collection address, access arrangements, preferred date and time, and contact information.
3.2 Quotations
Any quotation provided, whether verbally or in writing, is based on the information supplied by the Customer. Quotations are normally given according to estimated volume, weight, type of waste, and ease of access. Quotations are not binding until we have inspected the waste at the time of collection. We may revise the price if the information given was incomplete or inaccurate, or if the actual volume or type of waste differs from that described.
3.3 Booking confirmation
A booking will be deemed confirmed when we have accepted the Customer's request and provided confirmation by telephone, email, or booking message. We may, at our discretion, require a deposit or part payment to secure the booking. The Agreement comes into force once the booking is confirmed.
3.4 Access and parking
The Customer is responsible for ensuring that our vehicles have suitable access and parking at the collection address. Any parking charges, permits or penalties arising as a result of providing the Services may be charged to the Customer where they have not made reasonable arrangements.
The Customer must ensure that:
All waste intended for collection is clearly identified and, where required, separated by type.
There is safe, unobstructed access to the waste for our operatives and vehicles.
No hazardous, explosive, corrosive, medical, chemical or otherwise prohibited materials are included in the waste, unless explicitly agreed and compliant with applicable regulations.
Any required permissions from landlords, tenants, managing agents, neighbours or local authorities are obtained before the scheduled collection.
If the Customer is not present at the time of collection, clear instructions have been provided and safe access has been arranged.
We operate in accordance with UK waste regulations and duty of care obligations. The Customer must not present for collection any item that is illegal to handle, transport or dispose of, or that requires specialised treatment unless separately agreed.
Prohibited or restricted items may include, but are not limited to:
Asbestos or materials containing asbestos.
Clinical or medical waste, syringes, sharps, or biological material.
Chemicals, solvents, paints, oils, fuels, gas bottles, pressurised containers or hazardous liquids.
Explosives, firearms, ammunition or weapons.
Radioactive materials or unknown substances.
Refrigeration units, electrical equipment, or batteries that are not disclosed in advance and agreed for collection under applicable regulations.
We may refuse to collect any such items, and where they are mixed with general waste, we may decline the entire load or charge additional fees to cover safe handling and disposal in line with legal requirements.
6.1 Pricing
Our prices are usually based on a combination of volume, weight, type of waste, labour involved, loading time, and any additional services requested. We may also charge for congestion zones, tolls, parking, or difficult access where applicable.
6.2 Payment terms
Unless otherwise agreed in writing, payment is due in full on completion of the collection and before our vehicle leaves the site. Payment methods may include cash, bank transfer, card payment, or other methods we accept from time to time. For business customers with agreed credit terms, invoices must be paid in accordance with the payment terms stated on the invoice.
6.3 Late payment
We reserve the right to charge interest and reasonable recovery costs on overdue invoices in accordance with applicable UK legislation. We may suspend or cancel further services until outstanding amounts are settled.
6.4 Additional charges
If, on arrival, the load is significantly larger or heavier than booked, includes prohibited items, or requires extra labour or time beyond what could reasonably be expected from the description given, we may either adjust the price or decline the work. Any waiting time caused by the Customer or by lack of access may be charged at a reasonable hourly rate.
7.1 Customer cancellations
The Customer may cancel or amend a booking by contacting us as soon as reasonably possible. Where a cancellation is made at short notice, we may charge a cancellation fee to cover our administrative and scheduling costs, particularly where a vehicle and crew have already been dispatched.
We may apply the following general principles, unless otherwise specified in writing:
Cancellations made more than 24 hours before the scheduled collection time may be accepted without charge.
Cancellations made within 24 hours of the scheduled collection time may incur a reasonable cancellation fee.
Where we arrive at the collection address and are unable to complete the job due to lack of access, absence of the Customer where necessary, or other circumstances within the Customer's control, we may charge a call-out fee.
7.2 Our right to cancel or reschedule
We may cancel or reschedule a booking with as much notice as reasonably practicable in circumstances including, but not limited to, vehicle breakdown, staff illness, adverse weather, safety concerns, or other operational issues. Where possible, we will offer an alternative time or date. We will not be liable for any indirect loss or consequential costs arising from such cancellation or rescheduling.
We aim to provide waste collection services at the agreed time and date. However, any timeframes given for attendance or completion are estimates only and are not guaranteed. Collections can be affected by traffic, access, vehicle availability, and other factors beyond our reasonable control.
The Customer must allow a reasonable time window around the scheduled arrival time. We will use reasonable endeavours to notify the Customer of any significant delay or if we are unable to attend.
9.1 General liability
We will exercise reasonable care and skill in providing the Services. Our liability for loss or damage arising from our negligence or breach of this Agreement is limited as set out below.
9.2 Property damage
We will take reasonable care when working on or around the Customer's property. The Customer should inform us of any fragile areas, hidden pipes, cables, or other risks before work commences. We shall not be liable for damage arising from inherent defects, pre-existing conditions, or where reasonable care has been exercised.
We do not accept liability for damage to driveways, paths, or surfaces caused by the weight of our vehicles, where the Customer has directed us to park or drive on such areas.
9.3 Indirect or consequential loss
We are not liable for any indirect or consequential losses, including loss of profit, loss of business, or loss of opportunity arising out of or in connection with the Services or this Agreement.
9.4 Limits on liability
Nothing in these Terms and Conditions limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded by law.
Once the waste has been loaded onto our vehicle and payment has been made or agreed, title and responsibility for the waste pass to Waste Clearance Kingston. We will then transport and dispose of the waste in accordance with UK waste legislation, using authorised and appropriately licensed facilities.
We comply with the applicable duty of care for waste carriers and will manage waste in a way that promotes reuse and recycling where feasible. The Customer agrees to provide accurate information about the type and origin of the waste, to support compliance with regulatory requirements.
We collect and use personal information about Customers for the purpose of managing bookings, providing services, processing payments, and handling enquiries. We will keep personal data secure and will not share it with third parties except where necessary to provide the Services, process payments, comply with legal obligations, or where the Customer has given consent.
By using our Services, the Customer consents to the collection and use of their personal information as described in this clause, in accordance with applicable UK data protection laws.
If the Customer is dissatisfied with any aspect of the Services, they should contact us as soon as possible with details of the issue. We will investigate and, where appropriate, seek to resolve the matter promptly, which may include corrective work or a partial refund, at our discretion and subject to the circumstances.
We encourage Customers to raise any concerns on the day of service or within a reasonable time thereafter, so that evidence and information can be properly assessed.
We may update or amend these Terms and Conditions from time to time to reflect changes in law, regulation, industry practice, or our business operations. The version in force at the time of booking will apply to that booking. We may also adjust our services, pricing and payment methods from time to time.
We shall not be liable for any failure or delay in performing our obligations under this Agreement where such failure or delay results from events, circumstances or causes beyond our reasonable control, including but not limited to extreme weather, natural disasters, strikes, lock-outs, industrial disputes, acts of war or terrorism, pandemics, or failures of transport networks or utilities.
If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, unlawful or unenforceable, that provision shall be deemed deleted, and the remaining provisions shall continue in full force and effect.
These Terms and Conditions, together with any confirmed quotation or booking details, constitute the entire Agreement between Waste Clearance Kingston and the Customer and supersede any prior understanding, representation, or arrangement, whether oral or written, relating to the subject matter.
This Agreement and any dispute or claim arising out of or in connection with it, including non-contractual disputes or claims, shall be governed by and construed in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with this Agreement.
By proceeding with a booking or allowing our operatives to commence work, the Customer confirms that they have read, understood and agree to these Terms and Conditions for waste collection and clearance services.
